Information about the flex p-account
A flex p-account is one where the allowance is intertwined with incoming funds from certain entities, usually public institutions and/or an employer. Consequently, the monthly allowance is liable to change every calendar month.
For a flexible monthly allowance, we recommend a court order, as per § 907 ZPO.
We cannot set a p-account to have a flexible monthly allowance without appropriate documentation. Contacting N26 by chat or email or phone to say part of your salary is being garnished and thus the rest should be free to you is not sufficient. Documentation is needed.
If you have a flex P-account and your basic allowance is 1560 €, but your salary is 3000 €, your allowance for the month would change to 3000 €. Even if you receive your salary on the last day of the month, and the allowance resets to 1560 € the following day, you'll still be able to spend the salary amount by way of unspent leftover, as per § 899 Abs. 2 ZPO. Note that the allowance would not be set to 4560 € (3000 + 1560), unless this has been explicitly stated in the document stating you should have a flexible allowance.
If your salary is below your basic allowance, the allowance will remain as is.
For example, if your only salary payment in a month is 400 € and the basic allowance is 1560 €, the allowance will remain at 1560 €. There would be no reason to set a p-account allowance to 1960 € if your salary payment is 400 €.
Any blocked amount of that 400 € salary payment will still become available to you in the following month, as per § 900 paragraph 2 ZPO.
